Lucie Kačerová specialises in insolvency and corporate restructuring and civil litigation at ROWAN LEGAL. She has extensive experience in representing clients before international and Czech courts (including the European Court of Human Rights, EU courts, the Constitutional Court of the Czech Republic and the Supreme Court of the Czech Republic).

Lucie Kačerová focuses on representing clients in legally and economically complex cases with an emphasis on developing representation strategies. For several years, she has been leading a team that provides legal advice and representation to clients in more than 50 court proceedings, including promissory note disputes, discovery proceedings, enforcement proceedings, as well as insolvency proceedings, and has been involved in representing clients in legally complex litigation for damages for breach of competition worth hundreds of millions of CZK, which involves the necessity of interpreting the compliance of the Czech legal system with EU law. Most recently, Lucie has represented clients in creditors’ committees in the largest insolvency proceedings since the establishment of the Czech Republic. Lucie is a member of the Insolvency Section of the Czech Bar Association.

International court proceedings

Preparation of an application to the General Court of the EU for annulment of part of a European Commission regulation under Article 263 TFEU and Article 21 of the Statute of the Court of Justice of the EU.

Preparation of an appeal to the Court of Justice of the EU against a decision of the General Court of the EU within the meaning of Article 256(1) TFEU and Article 56 et seq. of the Statute of the Court of Justice of the EU.

Preparation of a complaint to the European Court of Human Rights concerning the operation of betting shops (infringement of the right to peaceful enjoyment of possessions and the principle of protection of legitimate expectations).

Preparation of a statement in the proceedings before the CJEU for a preliminary ruling under Article 267 TFEU.

National court proceedings

Preparation of factually and legally complex submissions to the civil courts of the Czech Republic, including the Supreme Court of the Czech Republic and the Constitutional Court.

Leading a team providing legal advice and representation to the client in more than 50 court proceedings, including promissory note disputes, urgent proceedings, enforcement proceedings, as well as insolvency proceedings.

Providing comprehensive legal advice in insolvency proceedings.

Preparation of factually and legally complex submissions to the administrative courts of the Czech Republic, including the Supreme Administrative Court of the Czech Republic and the Constitutional Court.

Representing clients in proceedings before the Financial Arbitrator.
