Jan Měkota specializes in competition law. He leads projects related to mergers of competitors, including the representation of clients in proceedings before the Office for the Protection of Competition and the European Commission. He also provides comprehensive legal services to clients in connection with the abuse of dominance and cartel agreements and in the field of state aid. Jan has also been involved in the creation and implementation of internal compliance systems focused primarily on prevention in the area of competition and criminal law. Jan mainly provides competition law advisory to clients in the area of ICT law, banking and finance, retail services, energy, and construction, as well as clients in the pharmaceutical and food industries. For these clients, Jan has also prepared a series of training sessions focusing on several competition issues including competition law responsibility, prevention of cartels, or best practice regarding dawn raids and investigations by competent authorities.

Jan Měkota is currently representing a number of clients in proceedings conducted by the Office for the Protection of Competition and provides daily support to them. In cartel law, Jan Měkota profits from his profound knowledge of public procurement and projects co-financed by the European Union’s Structural Funds.

 

Represents the operator of the Heureka portal in proceedings for an action for damages caused by the abuse of a dominant position by Google (2020 – present).

Leads the legal team involved in representing O2 Czech Republic in the proceedings conducted by the European Commission regarding the possible provision of illegal public support in connection with the determination of the conditions for the auction of frequency bands for 5 G networks (2020 – present).

He represents clients operating in the field of electrical installation work and energy construction in proceedings before Czech and foreign competition authorities. He successfully represented EGEM and PROFI EMG clients in proceedings before the Office for the Protection of Competition in an alleged cartel agreement in the distribution system operator’s contract, where the proceedings were terminated without any sanctions or negative consequences (2018 – present).

Represents the world’s leading manufacturer of network technologies in the investigation of the Office for the Protection of Competition in the matter of compliance with the terms of the partnership program (selective distribution system) in terms of competition and contract law (2020 – present).

He participated in the analysis of the feasibility of implementing a project for the construction of a new town hall worth hundreds of millions of crowns and the subsequent legal assessment of identified options, including assessing the possibility of dealing with the legal aspects of ownership of land intended for construction in a competitive dialogue for the client.

He provided comprehensive legal advice in the preparation of tender conditions and contractual provisions for the implementation of a public contract for the acquisition of an information system for the management of field workers worth tens of millions of crowns for a major electricity distribution system operator (2015 – 2016).

He provided comprehensive legal advice in the preparation of tender conditions and contractual provisions of public contracts for the conclusion of framework contracts in the field of design and implementation of electrical installation work with a total estimated value of billions of crowns for a major electricity distribution system operator (2015 – 2016).

He provided legal advice in the process for reviewing the contracting authority’s procedure in the tender procedure for Czech Television’s “Server technology for the production and broadcasting of news, sports and journalism” public contract, awarded in a competitive dialogue, with a value of around CZK 200 million excluding VAT before the Office for the Protection of Competition.
