Jiří Harnach is a specialist in the procedural law of public procurement and in the field of public investment in general. Within the ROWAN LEGAL office, he is the main guarantor of procedural advice to both contracting authorities and bidders for public contracts, in all steps following the contracting authority’s decision-making, in representation in administrative proceedings before the Office for the Protection of Competition and before the administrative courts.

Over the course of almost 20 years, Jiří Harnach has gained deep experience in public procurement law and providing legal support in defending the interests of contracting authorities and tenderers in the public procurement process, in many important projects (ICT, water management, waste management, construction, transport, education etc.), whose value has reached CZK 1 billion. He also provides partial legal opinions on key issues in the field of public procurement and concessions and has experience in preparing tender conditions and tenders.

Jiří Harnach publishes extensively in professional public procurement law periodicals, speaks at professional conferences, workshops, webinars and the like, and is also the co-author of the Commentary on the Public Procurement Act of 2016.

Other areas of law that Jiří is actively involved in include administrative law, the right to free access to information and the legislative process.

Contracting Provided comprehensive legal services related to the successful launch of a public procurement with a value of nearly CZK 300 million, not including VAT. A public procurement for the Czech Republic´s Ministry of Agriculture – „Operation and development eAGRI and related application infrastructure”.

Provided legal services related to the successful launch of this public procurement with a value of over 1 billion CZK, not including VAT, as well as co-ordination of subsequent procedural defense before the Office for the Protection of Competition. A public procurement for the contracting authority Prague 8 – “Centrum Palmovka.  Construction of office buildings and commercial spaces and their subsequent administration with the provision of related services”, entered in a competitive dialogue.

Represented CHAPS Ltd. in two proceedings, before the Brno Regional Court and the Supreme Administrative Court, brought against inaction with the execution of a request for information, where the Court fully agreed with the client and cancelled all previous verdicts by the Regional Court and halted the proceedings.

Provided comprehensive legal services related to the successful entry to the procurement by means of competitive dialogue (foreign tenderers, partially in English) with a value of nearly 300 million CZK, not including VAT. The contracting authority was the Technical University of Ostrava VŠB, a public procurement concerning the “Supercomputer – a large cluster”.Jiří participated in producing comprehensive tender specifications containing a binding model contract, which included the completion of the project`s center of excellence – IT4Innovations, which was financed by the research and development operational programme for innovation and implementation of the Supercomputing Centre, unique in the Czech Republic. Jiří completed the related comprehensive administration as well. The goal was acquisition of comprehensive technical research infrastructure in the “supercomputing” field.
