Michal Čáp

Michal Čáp has been an attorney since 2012 specializing in dispute resolution,

particularly international arbitration (commercial and investment). He also represents clients before Czech civil and administrative courts, as well as before administrative authorities. In addition, he serves as an arbitrator in commercial disputes and sports cases. He earned his LL.M. in Arbitration & Dispute Resolution from the University of Hong Kong in 2014.

Michal is registered and actively works as an arbitrator

on the list of arbitrators of the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic, and is also registered with HKIAC (Hong Kong), VIAC (Vienna) and SCIA (Shenzhen). He is a member of the Board of Referees of the Football Association of the Czech Republic.

Since 2022, he has been the Secretary of the National Court of Arbitration for Sport,

established at the National Sports Agency, which decides disputes related to doping in the Czech Republic. In this capacity, he oversees the management of all cases and the operation of the institution, especially from the legal side. Michal has been listed among the Arbitration Future Leaders from 2017 to 2025 (Who’s Who Legal and Global Arbitration Review).

Represented numerous clients (predominantly on the plaintiff’s side) at the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic in commercial disputes, mainly arising from work contracts or JV agreements.

Adjudicated disputes

Adjudicated disputes as a member of the panel or sole arbitrator at the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic involving, among others, contracts and unpaid rent. He has also acted as de facto tribunal secretary in dozens of cases, particularly at the Arbitration Court, including the preparation of procedural decisions.

Co-led a team

Co-led a team providing a legal opinion to the client on its investments (investor – state), arbitration proceedings against a state in the CEE region.

Represented a Czech bank in proceedings

Represented a Czech bank in proceedings in which the plaintiff (an unsuccessful defendant in arbitration proceedings) sought to have an arbitration award worth almost EUR 5 million annulled, including a submission to the Supreme Court of the Czech Republic, which confirmed the validity of the previous arbitration award.

Represented the Czech Cycling Federation in proceedings

Represented the Czech Cycling Federation in proceedings before the International Arbitration of Sport (CAS) and in ad hoc proceedings concerning participation in the 2024 Olympic Games in Paris. In the expedited proceedings, the accuracy and transparency of the qualification criteria set by the federation was confirmed. The claim of the cyclist who did not meet the federation’s nomination criteria was rejected.

Advises international financial companies

Advises international financial companies on resolving disputes with competitors, customers, and former employees (including prevention of these disputes). In addition, he provides general legal advice and represents clients in various stages of proceedings before public administration bodies (especially before the Czech National Bank) and ensures the provision of cooperation to law enforcement authorities.

Leads a team

Leads a team handling the dispute agenda of the largest water utility group in the Central European region, including negotiating an out-of-court settlement.

Advised to a client

Advised to a client regarding the lease of commercial premises in Prague, including the negotiation of a settlement agreement.

Provides legal advice to a bank and/or insurance company on export financing: various analyses and legal opinions, often involving a foreign element (including coordination with cooperating global law firms).

Provides legal advice to an Asian bank in connection with the assessment of the validity of collateral documentation, including the assessment of possible steps that the Asian creditor could take vis-à-vis the Czech target company.

Representing a major player in the waste management sector

A key member of the team representing a major player in the waste management sector in hundreds of administrative proceedings, dozens of administrative lawsuits, and various (pre-lawsuit) negotiations with its suppliers or contractual partners.

Representing an athlete in a doping case

Currently representing an athlete in a doping case before the relevant sports federation, including submissions before the Arbitration Commission of the Czech Olympic Committee.

Represented Matěj Tóth

Part of the team that successfully represented Matěj Tóth, the Slovak Olympic gold medalist in race walking, in disciplinary proceedings before the Disciplinary Commission of the Slovak Athletics Association, regarding the IAAF’s allegations of blood doping (biometric passport of the athlete).

Represented a Czech racecar driver

Represented a Czech racecar driver in all three stages of proceedings (disciplinary commission, appeal commission and Arbitration Commission of the Czech Olympic Committee) related to the suspected use of prohibited substances.

Represents several clients in court/arbitration proceedings

Represents several clients (plaintiffs and defendants) in court/arbitration proceedings related to the recovery of their business claims, including anticompetitive protection (recently his team won an appeal to the Supreme Court).

Advising a Czech mobile operator

Participated in advising a Czech mobile operator in its dispute with its alleged service supplier.

Provided legal advice

Provided legal advice to a major Czech IT company regarding imminent multijurisdictional disputes and helped revise its template contract documentation.

Negotiated a settlement and an installment agreement

Negotiated a settlement and an installment agreement on behalf of an English pharmaceutical company with direct enforceability with the debtor, a Czech company.

Represented an Asian financial broker

Represented an Asian financial broker in proceedings under the Criminal Code regarding the seizure of their accounts in the Czech Republic.

Participated in the acquisitions and sales of various companies

Participated in the acquisitions and sales of various companies, both in the Czech Republic and abroad (Hungary, USA, etc.).

Advised the client in negotiations with suppliers and contractors

Advised the client, an individual investor, in negotiations with suppliers and contractors of his real estate. The parties’ disputed rights and obligations were resolved by a settlement agreement.

Manages legal matters related to real estate, representing both sellers and buyers

In addition to his litigation agenda, Michal manages legal matters related to real estate, representing both sellers and buyers, and prepares or reviews future contracts, purchase agreements, and escrow agreements. He also advises on real estate leases and the establishment of easements, with a focus on water management infrastructure and related disputes.
