Michal Čáp

Michal Čáp has been an attorney since 2012 specializing in dispute resolution,

especially international arbitration (commercial and investment). He also represents clients before Czech civil and administrative courts and before administrative authorities. In addition, he is active as an arbitrator in commercial disputes and sports cases. He received his LL.M. (Arbitration & Dispute Resolution) at the University of Hong Kong (2014).

Michal is registered and actively works as an arbitrator on the list of arbitrators of the Arbitration Court

attached to the Czech Chamber of Commerce and the Agriculture Chamber of the Czech Republic, and is also registered with HKIAC (Hong Kong), VIAC (Vienna) and SCIA (Shenzhen). He is a member of the Board of Referees of the Football Association of the Czech Republic.

In June 2022, he was appointed secretary of the National Court of Arbitration for Sport,

established at the National Sports Agency, which decides disputes related to doping in the Czech Republic. In this capacity, he oversees the management of all cases and the operation of the institution, especially from the legal side.

Michal is listed in the list of Arbitration Future Leaders 2017 to 2023

(Who’s Who Legal and Global Arbitration Review), the only Czech to be included in 2023 (non-partners list).

Michal has represented numerous clients (predominantly on the plaintiff's side) at the Arbitration Court attached to the Economic Chamber of the Czech Republic and the Agricultural Chamber of the Czech Republic (the "Arbitration Court") in commercial disputes, mainly arising from work contracts or JV agreements.

• As a member of the panel or sole arbitrator, he has adjudicated disputes at the Arbitration Court involving, among others, contracts and unpaid rent. He has also acted as de facto tribunal secretary in dozens of cases, especially at the Arbitration Court, including the preparation of procedural decisions.

Arbitration against the state in Central and Eastern Europe

He co-lead a team providing a legal opinion to the client on its investments (investor – state), arbitration proceedings against a state in the CEE region.

Represented a Czech bank in proceedings

He represented a Czech bank in proceedings in which the plaintiff (an unsuccessful defendant in arbitration proceedings) sought to have an arbitration award worth almost EUR 5 million annulled, including a submission to the Supreme Court of the Czech Republic, which confirmed the validity of the previous arbitration award.

Leads the team handling the client's litigation agenda

He leads a team handling the dispute agenda of the largest water utility group in the Central European region, including negotiating an out-of-court settlement.
