Jan Bořuta specializes in the public sector, especially in the field of procurement law, construction law and contracts.
Currently, he primarily focuses on public investments. He provides legal services to both contracting authorities and suppliers for public contracts and concessions in procurement and concession proceedings, as well as proceedings before the Office for the Protection of Competition and courts.
Jan also deals with the administration of procurement procedures, contract document preparation, legal analysis and issues linked to financing projects for European and national funds.
He prepared complete tender documentation including the contract and he provided complex legal services for a public authority in the reconstruction of a protected building, the Emperor’s Spa, in a Karlovy Vary project, with a value of approx. CZK 830 million (2019).
He prepared comprehensive contractual documentation for the PPP Prague e-carsharing project for a client: Operátor ICT, a.s. (2018).
He prepared comprehensive contractual terms and contractual documentation for procurement in the implementation of a pilot project for supply, implementation and operation of smart metering of power consumption with an estimated value of more than EUR 4 million, excluding VAT. He has provided comprehensive legal services to the client E.ON Distribuce, a.s. in the submission of procurement (from 2017 – present).
He provided comprehensive legal services to the submitter in a submission for the procurement of maintenance, repairs and investments in a distribution system within an electricity network with a value of more than CZK 1 billion, excluding VAT. The client was E.ON Distribuce a.s. (2017 – 2018).
Jan participated in the preparation of contractual terms and contractual documentation of procurement: construction of a new building – the new Town Hall of Prague 12 with a value of CZK 480 million, excluding VAT. He has provided comprehensive legal services in submission procurement and the realization project for the client, Prague 12 District (from 2017 – present).
He participated in the creation of a comprehensive legal analysis about the transformation of Česká pošta, s.p., ICT Branch into an independent state firm and the impact of this transformation. The client was the Czech Republic, Ministry of the Interior. He worked especially on analyses of individual variations and the mechanism of creating a new state enterprise and assessment of the aspects of the application of in-house exemptions or horizontal cooperation and the budgetary aspects of the plan (2015).
