Jan Bořuta specialises in the public sector, in particular in public procurement law, construction law and contract law.

Currently, he focuses mainly on public investments, especially in the construction sector, including large infrastructure projects. Jan also has experience in the preparation and implementation of specific models of construction project implementation, such as the Design & Build method or Public-Private-Partnership (PPP). He provides legal advice to both public procurers and contractors in the field of tendering and concession proceedings as well as proceedings before the Office of Public Procurement and the courts.

Jan specialises in drafting tender conditions, contract documents, legal analyses and feasibility studies, administration of tendering procedures, and issues related to the financing of projects from European or national subsidies. It also provides clients with legal advice in the implementation phase of construction projects.

  • Provided comprehensive legal advice to the contracting authority in the procurement procedure for the award of public contracts for maintenance, repairs and investment activities in the distribution system worth more than CZK 5.5 billion excluding VAT for the client EG.D, a.s. (2020-2021).
  • Prepared complete tender conditions, including contract documentation, and provided comprehensive legal advice to the client for a public procurement contract for the construction of a new pavilion of the Masaryk Hospital in Ústí nad Labem worth more than CZK 1 billion (2020).
  • Drafted complete tender conditions including contract documentation and provided comprehensive legal advice to the contracting authority for the public contract for the reconstruction of the listed building of the Imperial Spa in Karlovy Vary worth approx. CZK (2019).
  • Drafted complex contractual documentation for the concession project for electric car sharing in the capital city of Prague for the client Operátor ICT, a.s. (2018).
  • Prepared comprehensive contractual documentation for the purchase, maintenance, repair and continued airworthiness of aircraft with English language flight verification equipment for airborne ground equipment in the value of approx. EUR 25 million excluding VAT for the client Řízení letového provozu České republiky, s.p. (2017).
  • Prepared complete tender conditions including contractual documentation for a public contract for the implementation of a pilot project for the supply, implementation and operation of smart metering technology for electricity consumption with an estimated value of more than EUR 4 million excluding VAT and provided comprehensive legal advice during the procurement process for the client E.ON Distribuce a.s. (since 2017 to date).
  • Participated in the preparation of the tender conditions, including contractual documentation, for the design and construction of the new City Hall of the Prague 12 Municipal District using the Design & Build method, worth approx. CZK, excluding VAT, including providing comprehensive legal advice during the procurement process and provided complete legal advice during the implementation phase of the project for the client, the Municipal District of Prague 12 (since 2017 to date).
  • Participated in the preparation of a comprehensive legal analysis for the client Czech Republic – Ministry of the Interior regarding the possibilities of transformation of Česká pošta, s.p., a spin-off plant of ICT services, into an independent state enterprise and the impact of this transformation. Within this analysis, he mainly worked out the various options and mechanisms for the creation of a new state enterprise, the assessment of aspects of the application of the in-house exception or horizontal cooperation and the budgetary aspects of the plan (2015).
  • He was involved in providing comprehensive legal advice to the in-house company of the City of Prague, Operator ICT, a.s., in connection with solving current problems of the Opencard project, as well as in finding a suitable and long-term sustainable future solution of the transport and customs clearance system on the territory of the so-called Prague Integrated Transport. As part of these services, he was mainly involved in the preparation of extensive related contractual documentation (2015-2016).
  • Participated in the provision of legal advice to the Ministry of Transport, Construction and Regional Development of the Slovak Republic (formerly the Ministry of Transport, Posts and Telecommunications of the Slovak Republic) – legal advice in the preparation and implementation of the concession project “Koncesia na projektovanie, budowa, finansia, prevádz i údržby sekov diaľnice D4 Jarovce – Rača a rych rychlostnej cesty R7 Bratislava Prievoz – Holice, projekt PPP” with an estimated value of approx. The advisory services included in particular legal support during the concession procedure, especially in the phase of assessment and evaluation of compliance with the conditions of participation (2015).
